Testifying as a Character Witness
A judge shall not testify as a character witness in a judicial, administrative,
or other adjudicatory proceeding or otherwise vouch for the character of a
person in a legal proceeding, except when duly summoned.
History
Comment. — A judge who, without being subpoenaed, testifies as a character witness abuses the prestige of judicial office to advance the interests of another. See Rule 1.3. Presiding judge may be witness of probation violation. — The mere fact that a judge presided over the defendant’s revocation proceedings after observing a violation of her probation (i.e., drinking in a bar) was not sufficient to establish plain error. The defendant requested that she be able to testify and freely admitted that she had violated the terms of her probation by drinking alcoholic beverages (decided under prior code). Lozano v. State, 751 P.2d 1326, 1988 Wyo. LEXIS 36 (Wyo. 1988).
