W. Va. Code of Jud. Conduct Application I
I. Applicability of this Code
(A) Anyone, whether or not a lawyer, who is an officer of a judicial system and who performs judicial functions, including but not limited to Justices of the Supreme Court of Appeals, Intermediate Court of Appeals Judges, Circuit Court Judges, Family Court Judges, Magistrates, Mental Hygiene Commissioners, Juvenile Referees, Special Commissioners and Special Masters, is a judge within the meaning of the Code.
(B) All judges shall comply with this Code except as provided in II through V of the Application section.
(C) All judges-designate shall comply with Rules 1.1, 1.2, 1.3, 2.10, 2.15, 2.16, 3.1(C)-(D), 3.6, 3.7(A)(2), and 4.1 of this Code.
(D) All judicial candidates shall comply with Rule 2.16 and Rules 4.1 through 4.5 of this Code.
History
COMMENT [1] For the purposes of this Canon, as long as a retired judge is subject to recall, the judge is considered to "perform judicial functions." The determination of which category and, accordingly, which specific Code provisions apply to an individual judicial officer, depend upon the facts of the particular judicial service. [2] The Code does not apply to an administrative law judge, hearing examiner, or similar officer within the executive branch of government, or to municipal judges.
