Abuse: Advisory Verdict as to Perpetrator

It is not necessary for (petitioner) to establish the identity of the person (or persons)

who committed the alleged abuse. However, it may be helpful to the court, if it is necessary

to determine what protection or services to order, to know the identity of that person (or

persons). Therefore, if you find that (child) was a victim of abuse, you should also answer the

following question:

Can the jury identify who committed the abuse by evidence that is clear,

satisfactory, and convincing, to a reasonable certainty?

You should answer this question either "yes" or "no." If you answer this question

"yes," you should write the name (or names) of the person(s) on the lines provided.

Please keep in mind that the question whether the child is a victim of abuse is

completely independent of and unrelated to the question as to the identity of the person(s)

who committed the abuse. A child can be found to be a victim of abuse even if the identity of

(that person) (those persons) is unknown.
