ENTRY ORDER

Remote and hybrid participation in Environmental Division proceedings is governed by

Vermont Rule of Civil Procedure (V.R.C.P.) 43.1. All non-evidentiary proceedings are conducted

remotely via the Zoom platform. For evidentiary hearings, V.R.C.P. 43.1 provides that the presiding

judge may order a hearing to be scheduled as remote or hybrid for good cause based on a consideration

of the following non-exhaustive list of factors:

(1) Whether the locations involved in the proceeding have the requisite technological

capabilities;

(2) The health, safety, and convenience of the parties, counsel, court personnel, and proposed

witnesses;

(3) The importance, complexity, nature, and expected duration of the proceeding, as well as

the time and expenses of travel.

(4) Any other factors, listed in V.R.C.P. 43.1 or otherwise, that the court deems relevant.

V.R.C.P. 43.1(d), (h).

Upon consideration of these factors, and until further notice, any Notice of Hearing in a case

in this Division that specifies that a hearing is remote or hybrid is sufficient to give the required notice

under V.R.C.P. 43.1. The Court retains discretion to permit or require in-person participation and to

alter the terms of this standing order in a particular case. To request an alternative means of

participation, a party must file a motion pursuant to V.R.C.P. 43.1(d)(2).

This Order shall remain in effect until September 7, 2027
