VERMONT SUPREME COURT

JANUARY TERM, 2026

Order Promulgating Amendments to Rule 11(f) of the 2020 Vermont Rules for Electronic Filing

Pursuant to the Vermont Constitution, Chapter II, § 37, and 12 V.S.A. § 1, it is hereby ordered:

1. That Rule 11(f) of the 2020 Vermont Rules for Electronic Filing be amended as follows (new

matter underlined; deleted matter struck through):

RULE 11. SERVICE

(f) Notice of Court Orders and Documents. The court will transmit any notice, order, or other

document issued by the court to electronic filers and by electronic means. Notice to parties who are

not electronic filers will be provided by mail or electronic means the means specified in the

applicable rules of procedure for circumstances where these rules specify no alternative means.

Reporter’s Notes—2026 Amendment

Rule 11(f) is amended to conform to current practice. When first

enacted, Rule 11(f) indicated that all electronic filers would receive

transmission of court notices, orders, and other documents through

electronic means. Due to technical constraints, the automated electronic

notice through the case-management system is available only for

attorneys and not for self-represented litigants who choose to

electronically file. In general, courts send official notices of court

orders, calendars, and other documents to self-represented litigants

using regular mail. To alleviate confusion and provide flexibility, the

subdivision is amended to simply indicate that the court will transmit

notices and orders to all parties and that the method may vary.

2. That this amendment be prescribed and promulgated, effective on July 1, 2026. The Reporter’s

Notes are advisory.

3. That the Chief Justice is authorized to report these amendments to the General Assembly in

accordance with the provisions of 12 V.S.A. § 1, as amended.
