Definition of “harassing” (context of a charge for violation of conditions of release)

(Def)_______________ is charged with violating his conditions of release by harassing (victim)_______________.

To harass another person means to intentionally engage in conduct that annoys the other person. The conduct might consist of words, gestures, offensive touching, telephone calls, or other action. The conduct may be harassment if it tends to annoy, irritate, torment, or alarm the other person.

In this context, “harassment” requires proof of active or intentional participation by (Def)_______________. The mere fact that the other person is annoyed is not enough to show that (Def)_______________ is guilty of harassment. Also, the word “harassment” means that (Def)_______________’s conduct was persistent. A single inadvertent incident is not harassment, whereas persistent, repeated annoying conduct directed at another person may be found to be harassment.

The State must have proven that (Def)_______________ violated his conditions of release by harassing (victim)_______________.
