Vermont Model Criminal Jury Instructions CR05-111
WITNESS TESTIFYING UNDER PLEA AGREEMENT
[This instruction concerns one witness. For an instruction on more than one witness, see CR05-112.]
(Witness)_______________ testified in this case under a plea agreement [he] [she] made with the State. This evidence has been introduced because it may bear on the witness’s credibility.
You should evaluate the testimony of this witness in light of [his] [her] situation and relation to the alleged offense. Consider whether this witness’s testimony was colored in such a way as to further [his] [her] own interest. You may find that a witness who testifies under a plea agreement has a motive to give false testimony, or you may find that the witness has testified truthfully. Whether to believe this witness’s testimony, and how much weight to give it, is up to you.
