Vermont Model Criminal Jury Instructions CR02-031
THE CHARGE IS NOT EVIDENCE
The fact that (Def)_______________ is on trial is not evidence against [him] [her]. Likewise, the charge that the State’s Attorney has filed is not evidence of guilt. You are not to be influenced by the fact that the State has brought this charge against [him] [her]. (Def)_______________’s plea of not guilty places the burden on the State to prove guilt.
