Va. Model Jury Instr. Crim. No. P22.360
Schedule I or II Controlled Substance—Possession With Intent to Sell, Give, or Distribute: Evidence of Accommodation
You have found the defendant guilty of the crime of possessing with intent to distribute (name of
drug), which is a Schedule [I; II] controlled substance.
In determining the punishment, unless you find that the defendant possessed (name of drug) with
the intent to distribute only as an accommodation to another and not with the intent to profit or to
induce the recipient to use or become addicted to or dependent upon (name of drug), you shall fix
his punishment at a specific term of imprisonment, but not less than five (5) years nor more than
forty (40) years and a fine of a specific amount, but not more than $500,000.
If you have found beyond a reasonable doubt that the defendant possessed (name of drug) with
the intent to distribute, but further find from the greater weight of the evidence that this was done
only as an accommodation to another and not with the intent to profit or to induce the recipient to
use or become addicted to or dependent upon (name of drug), then you shall fix his punishment at:
(1) A specific term of imprisonment, but not less than one (1) year nor more than ten (10) years;
or
(2) Confinement in jail for a specific time, but not more than twelve (12) months; or
(3) A fine of a specific amount, but not more than $2,500; or
(4) Confinement in jail for a specific time, but not more than twelve (12) months, and a fine of a
specific amount, but not more than $2,500.
