Illegal Purchase or Possession—By Persons Not Permitted to Purchase or Possess
The defendant is charged with the crime of illegally [purchasing; consuming; possessing;
attempting to purchase; attempting to consume; attempting to possess] an alcoholic beverage. The
Commonwealth must prove beyond a reasonable doubt each of the following elements of that
crime:
(1) That the defendant [purchased; consumed; possessed; attempted to purchase; attempted to
consume; attempted to possess] an alcoholic beverage; and
(2) That at the time of such [purchase; consumption; possession; attempt to purchase; attempt to
consume; attempt to possess], the defendant was [less than twenty-one years old; a person to whom the
sale of alcoholic beverages is prohibited by court order; an intoxicated person].
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
each of the above elements of the crime as charged, then you shall find the defendant guilty, [but
you shall not fix the punishment until your verdict has been returned and further evidence has
been heard by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt either or
both elements of the crime as charged, then you shall find the defendant not guilty.
