Va. Model Jury Instr. Crim. No. 6.250
Illegal Sale—To Persons Not Permitted to Buy
The defendant is charged with the crime of illegally selling an alcoholic beverage to [a person;
persons] not permitted to buy an alcoholic beverage. The Commonwealth must prove beyond a
reasonable doubt each of the following elements of that crime:
(1) That the defendant sold an alcoholic beverage; and
(2) That at the time of such sale, the defendant knew or had reason to believe that the
individual(s) to whom the sale was made was [less than twenty-one (21) years old; a person to whom
the sale of alcoholic beverages is prohibited by court order; an intoxicated person].
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
each of the above elements of the crime as charged, then you shall find the defendant guilty, [but
you shall not fix the punishment until your verdict has been returned and further evidence has
been heard by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt either or
both elements of the crime as charged, then you shall find the defendant not guilty.
