Manufacturing While Armed
The defendant is charged with the crime of unlawfully manufacturing [transporting; selling]
alcoholic beverages while in possession of a (specify dangerous weapon described in Va. Code Ann.
§ 18.2-308(A)). The Commonwealth must prove beyond a reasonable doubt each of the following
elements of that crime:
(1) That the defendant engaged in the unlawful [manufacture; transport; sale of alcoholic beverages];
and
(2) That, while doing so, the defendant [carried on or about his person; had in his possession, actual
or constructive, within 100 yards of any place where the alcoholic beverages were being manufactured;
had on or in any vehicle that he may have used to aid him in such purchase] a (specify dangerous
weapon described in Va. Code Ann. § 18.2-308(A)).
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
each of the above elements of the crime as charged, then you shall find the defendant guilty, [but
you shall not fix the punishment until your verdict has been returned and further evidence has
been heard by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt either or
both elements of the crime as charged, then you shall find the defendant not guilty.
