The defendant is charged with the crime of operating an illegal gambling enterprise, activity or
operation [continuously for a period of time in excess of thirty (30) days; having a gross revenue of
$2,000 or more in a single day]. The Commonwealth must prove beyond a reasonable doubt that the
defendant was the operator of an illegal gambling enterprise [continuously for a period of time in
excess of thirty (30) days; having a gross revenue of $2,000 or more in a single day].
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
the offense as charged, then you shall find the defendant guilty, [but you shall not fix the
punishment until your verdict has been returned and further evidence has been heard by you].
If you find that the Commonwealth has failed to prove the offense beyond a reasonable doubt,
then you shall find the defendant not guilty.
