Va. Model Jury Instr. Crim. No. 29.420(a)(1)
Distribution, etc., of Child Pornography
The defendant is charged with the crime of [distributing; reproducing; selling; giving away;
displaying; electronically transmitting; purchasing; or possessing with the intent to sell, give away,
distribute, transmit, or display] child pornography. The Commonwealth must prove beyond a
reasonable doubt that the defendant knowingly [distributed; reproduced by any means, including by
computer; sold; gave away; displayed; transmitted electronically; purchased; or, possessed with the
intent to sell, give away, distribute, transmit, or display] child pornography.
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
the above element of the crime as charged, then you shall find the defendant guilty [but you shall
not fix the punishment until your verdict has been returned and further evidence has been heard
by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt the above
element of the crime, then you shall find the defendant not guilty.
