Va. Model Jury Instr. Crim. No. 29.380
Criminal Negligence
Criminal negligence is a standard that is higher than mere lack of ordinary care. Criminal
negligence consists of a reckless or indifferent disregard of human life, under circumstances
reasonably calculated to produce serious injury or death, or which make it probable that serious
injury or death will occur. To constitute criminal negligence, the Commonwealth must show that
the defendant knew or should have known that the probable result of his acts would be a serious
injury or death to the child.
