Va. Model Jury Instr. Crim. No. 26.280
Evidence of Intent to Defraud
You may consider as evidence of an intent to defraud the fact that the defendant signed the
lease or rental agreement with a name other than his own, or failed to return such property to the
person or business he leased it from within 30 days after the giving of written notice to the
defendant that the lease or rental period for the property had expired.
Notice mailed by certified mail and addressed to the defendant at the address the defendant
stated in the lease is sufficient to give written notice.
