Va. Model Jury Instr. Crim. No. 22.701
Drug Paraphernalia—Sale to Person Who Is At Least 3 Years Younger Than The Defendant
The defendant is charged with the crime of selling drug paraphernalia to a person under 18
years of age who is at least 3 years younger than the defendant. The Commonwealth must prove
beyond a reasonable doubt each of the following elements of that crime:
(1) That the defendant sold drug paraphernalia to (name of person to whom paraphernalia was sold);
and
(2) That (name of person to whom paraphernalia was sold) was under the age of 18 years at the time
of the distribution and at least 3 years younger than the defendant; and
(3) That the defendant, at the time of the sale, was at least eighteen (18) years of age.
If you find from the evidence that the Commonwealth has proved each of the elements of the
crime set out above beyond a reasonable doubt, then you shall find the defendant guilty [but you
shall not fix the punishment until your verdict has been returned and further evidence has been heard by
you].
If you find that the Commonwealth has failed to prove one or more of these elements beyond a
reasonable doubt, then you shall find the defendant not guilty.
