Va. Model Jury Instr. Crim. No. 22.320
Marijuana—Possession With Intent to Sell, Give, or Distribute: No Evidence of Accommodation
The defendant is charged with the crime of possession with intent to distribute more than one
ounce but not more than five (5) pounds of marijuana. The Commonwealth must prove beyond a
reasonable doubt that the defendant possessed with intent to distribute more than one ounce but
not more than five (5) pounds of marijuana.
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
the crime as charged, then you shall find the defendant guilty [but you shall not fix the punishment
until your verdict has been returned and further evidence has been heard by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt that the
defendant possessed with intent to distribute marijuana, then you shall find the defendant not
guilty.
