Va. Model Jury Instr. Crim. No. 22.260
Marijuana—Selling, Giving, or Distributing: Evidence of Accommodation
The defendant is charged with the crime of distributing more than one ounce but not more than
five (5) pounds of marijuana. The Commonwealth must prove beyond a reasonable doubt that the
defendant distributed more than one ounce but not more than five (5) pounds of marijuana.
If you find from the evidence that the Commonwealth has proved beyond a reasonable doubt
that the defendant distributed more than one ounce but not more than five (5) pounds of
marijuana, then you shall find the defendant guilty [but you shall not fix the punishment until the
verdict has been returned and further evidence has been heard by you].
If you find that the Commonwealth has failed to prove beyond a reasonable doubt that the
defendant distributed marijuana, then you shall find the defendant not guilty.
