Alcohol Concentration—More Than 0.05 But Less Than 0.08

activein force · 2025-10-01 – presentcompiled-edition

You have received evidence of the amount of alcohol in the blood of the defendant at the time

that a chemical test was administered. If at that time the amount of alcohol in the blood of the

defendant was more than 0.05 but less than 0.08, there is no presumption that the defendant was

or was not under the influence of alcohol at the time of the alleged offense, but the evidence of the

amount of alcohol in the blood of the defendant at the time that a chemical test was administered

may be considered by you with other evidence in determining the guilt or innocence of the

defendant.
