Va. Model Jury Instr. Crim. No. 21.300

Alcohol Concentration—0.05 or Less

activein force · 2025-10-01 – presentcompiled-edition

You have received evidence of the amount of alcohol concentration of the defendant at the

time that a chemical test was administered. If at that time the concentration was 0.05 or less,

there is a rebuttable presumption that the defendant was not under the influence of alcohol at the

time of the alleged offense. This presumption may be rebutted by other evidence.
