Va. Model Jury Instr. Civ. No. 49.400
Expert Opinion; Jury’s Determination as to Sexually Violent Predator
Mental health experts are permitted to testify at the trial regarding their diagnoses and their
opinions as to whether the respondent meets the definition of a sexually violent predator.
However, such opinions shall not be dispositive of whether the respondent is a sexually violent
predator; you are to make the determination of whether the respondent is a sexually violent
predator based upon all the evidence.
