Va. Model Jury Instr. Civ. No. 43.020
Procuring Cause: General
To earn his commission, a broker must have been the predominant, procuring cause of the sale.
This means that he must have been responsible for causing a series of events which, without a
break in their continuity, [produced a purchaser ready, willing and able to buy on the seller’s terms;
resulted in a completed sale].
If the services of a broker are the predominant procuring cause of the sale, then he is entitled
to his commission even if the seller completes the sale directly with the buyer.
