Va. Model Jury Instr. Civ. No. 39.050
Duty to Investigate
A person to whom a misrepresentation was made has no duty to investigate unless he had or
obtained information about the representation which would cause a reasonably prudent person to
investigate.
If a person has a duty to investigate a representation and fails to investigate to the extent that
a reasonably prudent person would, then he is bound by all knowledge that such an investigation of
that representation would have disclosed.
