Va. Model Jury Instr. Civ. No. 36.090
Compensatory Damages
If you find your verdict in favor of the plaintiff, then in determining the damages to which he is
entitled you may consider any of the following you believe by the greater weight of the evidence
was caused by the [assault; battery; assault and battery] committed by the defendant:
(1) all financial loss resulting from the injury the defendant caused to the plaintiff;
(2) all physical injury the plaintiff suffered;
(3) any shame, humiliation, embarrassment, or indignity the plaintiff suffered.
In awarding damages, you may also consider the insulting character of the injury to the
plaintiff, the defendant’s reason for injuring the plaintiff, and any other circumstances shown by
the evidence which make the injury more serious.
Your verdict shall be for such sum as will fairly and fully compensate the plaintiff for the
damages sustained as a result of the [assault; battery; assault and battery].
