Va. Model Jury Instr. Civ. No. 34.155
Manufacturer’s Duty to Warn: Medications
The manufacturer of a prescription drug or medication has the duty to warn the prescribing
physician about the possible dangers to patients who use the drug or medication. This is to enable
the physician to give an adequate warning of the dangers to the patient. If, however, a drug
manufacturer warns against a particular use of the drug or medication, it need not explain exactly
how improper use might affect the patient.
