Va. Model Jury Instr. Civ. No. 34.040
Implied Warranty: Fitness for a Particular Purpose
When a seller knows, or has reason to know, that the product he is selling is to be used for a
particular purpose and that the buyer is relying on the seller’s skill or judgment in selecting or
furnishing a product suitable for that purpose, then the seller creates an implied warranty that the
product will be fit for that particular purpose.
