Intentional Infliction of Emotional Distress: Issues
Your verdict must be based on the facts as you find them and on the law contained in these
instructions.
The issues in this case are:
(1) Did the defendant [have the specific purpose of inflicting emotional distress upon the plaintiff;
intend his specific conduct and know, or should have known, that his conduct would likely result in
emotional distress];
(2) Was the defendant’s conduct outrageous and intolerable in that it offends the generally
accepted standards of decency and morality;
(3) Did the plaintiff suffer severe emotional distress; and
(4) Was the plaintiff’s severe emotional distress proximately caused by the defendant’s conduct?
On these issues, the plaintiff has the burden of proof.
Your decisions on these issues must be governed by the instructions that follow.
