Va. Model Jury Instr. Civ. No. 24.050
Waste: Double Damages
A landlord may recover double damages from his tenant if the tenant wantonly committed
waste. A tenant wantonly commits waste if:
(1) he was conscious of his conduct; and
(2) he knew from existing conditions that damage would probably result from his conduct; and
(3) he consciously and intentionally, with reckless indifference to the consequences, [did a wrongful
act; omitted a known duty] that caused injury to the landlord’s premises.
