Va. Model Jury Instr. Civ. No. 24.025
Burden of Proving Landlord’s Failure to Exercise Reasonable Care in Making Repairs
Where the landlord undertakes to make repairs, the tenant has the burden of proving by the
greater weight of the evidence that the landlord failed to use reasonable care in making repairs. A
showing that a defect remained after repairs were made is, by itself, insufficient to satisfy this
burden.
