Occupant’s Duty to Law-Enforcement Officers, Fire Fighters and Other Designated Personnel
Where an occupant of premises:
(1) knows, or has reason to know, of a dangerous condition on his premises; and
(2) knows, or has reason to know, of the presence on his premises of a [law-enforcement officer;
fire fighter; individual designated in § 8.01-226]; and
(3) knows, or has reason to know, that the [law-enforcement officer; fire fighter; individual
designated in § 8.01-226] is unaware of the dangerous condition;
then an occupant has the duty to use ordinary care either to make the condition reasonably safe
or to warn the [law-enforcement officer; fire fighter; individual designated in § 8.01-226] of the
dangerous condition.
If an occupant fails to perform this duty, then the occupant is negligent.
