Duty of Care Owed to Passengers Generally

activein force · 2026-04-01 – presentcompiled-edition

The defendant is a common carrier. A common carrier has the duty to use the highest degree of

that could have been foreseen and guarded against, but it is not an insurer of the safety of its

passengers.

If the defendant fails to perform this duty, then it is negligent.
