Va. Model Jury Instr. Civ. No. 21.060
Present Value
If you find in favor of the plaintiff and make an award for any loss of earnings or expense in the
future, you must take into account the fact that the money awarded by you is being received all at
one time instead of over a period of time extending into the future and that the plaintiff will have
use of this money in a lump sum. You must, therefore, determine the present value or present
worth of the money which you award for such future loss.
The present value of future damages is the sum of money needed now to fully compensate the
plaintiff for future damages such that, if it was invested now and received a reasonably risk-free
rate of interest between now and the time when the damages will be sustained, it will equal the
amount of those damages at the time in the future when they will be incurred.
