Va. Model Jury Instr. Civ. No. 18.192
Railroad’s Duty to Clear Obstructions from Sightlines
A railroad has a duty to remove or warn about any object, whether structural or natural, that is
within the railroad’s right-of-way and that obstructs the clear sightlines at a crossing [of railroad
signs or signals; of or from an approaching train].
If a railroad fails to perform this duty, then it is negligent.
