Va. Model Jury Instr. Civ. No. 18.191
Railroad’s Duty to Remove Vegetation Obstructing Sightlines
A railroad has a duty to control vegetation in its property on or immediately adjacent to the
roadbed so that it does not obstruct visibility of railroad signs and signals along the right-of-way
and at public crossings.
If a railroad fails to perform this duty, then it is negligent.
