Va. Model Jury Instr. Civ. No. 18.020
Driver’s Duty to Look and Listen at Crossing Even If There Is No Warning of a Train
The driver of a vehicle has a duty to use ordinary care to look and listen effectively for an
approaching train before crossing the tracks even if a railroad fails to [lower the crossing gate;
sound a whistle or horn or bell; give a flag signal; etc.] as a warning that its train is approaching the
crossing.
If a driver fails to perform this duty, then he is negligent.
