D.V.I. LRCr 1.3

(a) Generally. Unless exigent circumstances exist, a movant shall seek concurrence from each

other party before filing a motion.

(b) Exceptions. LRCr. 1.3(a) does not apply to:

(1) Motions identified in Federal Rule of Criminal Procedure 12(b)(3)(A)-(D);

(2) Motions for judgment of acquittal under Federal Rule of Criminal Procedure 29;

(3) Motions for new trial under Federal Rule of Criminal Procedure 33;

(4) Motions to dismiss;

(5) Motions for reconsideration; and

(6) Motions seeking a pre-trial ruling on the admissibility of evidence at trial.

(c) Representation. All motions other than the motions identified in LRCr. 1.3(b) shall either

(i) contain a representation that the movant sought concurrence in the motion from each party,

and that it has been either given or denied, or (ii) identify the circumstances that prevented

concurrence from being sought or obtained.

(d) Interaction with Other Consultation Requirements. To the extent that the Federal Rules

of Criminal Procedure or the Local Rules of Criminal Procedure specify a different

consultation requirement for a specific motion, those rules govern.

(e) Detained pro se defendants. This rule does not apply to detained pro se defendants or require

consultation with detained pro se defendants.
