Review of Magistrate Judge Detention and Release Orders

(a) Motion.

A party may file a motion seeking review of a magistrate judge’s order releasing

or detaining a defendant or material witness under 18 U.S.C. § 3145. A response

is not required unless the court orders otherwise.

(b) Hearing.

The district judge will promptly schedule a hearing on the motion to conduct a de

novo review.

(c) Motion to Stay the Magistrate Judge’s Detention or Release Order.

If a party files a motion to stay the magistrate judge’s order, the magistrate judge

who issued the release or detention order will rule on the motion to stay.
