Judicial Misconduct and Disability
(a) 28 U.S.C. § 372(c) provides a way for any person to complain about a Judge
who the person believes "has engaged in conduct prejudicial to the effective and
expeditious administration of the business of the courts" or "is unable to discharge all the
duties of office by reason of mental or physical disability." It also permits the judicial
councils of the circuits to adopt rules for the consideration of these complaints. The
Judicial Council of the Sixth Circuit has adopted "Rules of the Judicial Council of the
Sixth Circuit Governing Complaints of Judicial Misconduct or Disability" under the
authority of 28 U.S.C. § 372(c). A copy of these rules is on file with the Office of the
Clerk.
(b) Pursuant to the rules adopted by the Judicial Council of the Sixth Circuit,
complaints shall be filed with the Circuit Executive for the Sixth Circuit Court of Appeals
on a form that can be obtained from that office.
