S.D.N.Y. Local Civil Rule 39.2
Order and Length of Summations
After the close of evidence in civil trials, the order of summation shall be determined in
the discretion of the Court. The court has discretion to determine the length and order
of summations, including whether to allow a rebuttal summation.

History
PRE-2024 COMMITTEE NOTE The Committee believes that Local Civil Rule 39.2 serves a useful role in clarifying the power of the Court to determine the order of summation. 2026 COMMITTEE NOTE The rule has been amended to confirm that the court has discretion not only with respect to the order of summations, including whether to allow a rebuttal summation, but also over the length of summations. The amendment is also intended to make plain that the court may exercise this discretion at any time.
