S.D.N.Y. Local Civil Rule 30.4
Conferences Between Deponent and Defending Attorney
[formerly Local Civil Rule 30.6]
An attorney for a deponent must not initiate a private conference with the deponent
while a deposition question is pending, except for the purpose of determining whether
a privilege should be asserted.

History
[formerly Local Civil Rule 30.6] PRE-2024 COMMITTEE NOTE The Committee believes that this Local Civil Rule serves a useful purpose, and that it is consistent with (although not duplicative of) Fed. R. Civ. P. 30(c)(2) and 20(d)(2). The Committee believes that there is a broad consensus that it is improper for the deponent’s attorney to initiate a private conference with the deponent while a question is pending. By recommending that this minimum standard be stated in the rule, the Committee does not intend any negative implication that other types of obstructive conduct during depositions may not be dealt with by appropriate orders of the Court.
