Persons Attending Depositions [formerly Local Civil Rule
30.4]
A person who is a party in the action may attend the deposition of a party or witness. A
witness or potential witness in the action may attend the deposition of a party or
witness unless ordered otherwise by the court.

History
30.4] PRE-2024 COMMITTEE NOTE This rule provides a useful summary of the rules regarding who may attend a deposition, and the Committee recommends that it be extended to the Southern District as well as the Eastern District. The exclusion-of-witnesses rule of Fed. R. Evid. 615 is made inapplicable to depositions by Fed. R. Civ. P. 30(c)(1), but Fed. R. Civ. P. 26(c)(1)(E) allows the Court, for good cause, to “designat[e] the persons who may be present while the discovery is conducted.”
