Actions against persons on probation or supervised release requiring a hearing
(a) Preliminary or Revocation Proceedings
(i) Person not in custody: The probation office will prepare and electronically
file the summons and serve the person under supervision with the summons.
All other necessary parties will be notified of the date of the hearing by the
CM/ECF system. This includes the marshal, the United States Attorney, the
defendant’s attorney, if the person is represented.
(ii) Person in custody: All necessary parties will be notified of the date of the
hearing by the CM/ECF system. This includes the marshal, the person
responsible for issuing a writ, if needed, the probation office, the United
States Attorney, the defendant and/or the defendant’s attorney, if the person
is represented.
(b) Modification Hearings – The probation office will secure the hearing date from the
chambers of the judge conducting the hearing, prepare and electronically file the
summons, and serve the person under supervision with the summons. All other
necessary parties will be notified of the date of the hearing by the CM/ECF system.
This includes the marshal, the United States Attorney, and the defendant’s attorney,
if the person is represented.
