Appeals of Orders Relating to Release or Detention; Release Before Judgment of
Conviction
(a) An appeal from an order granting or denying release from custody with or without
bail or for detention of a defendant prior to judgment of conviction must be by motion filed
either concurrently with or promptly after filing a notice of appeal. The movant must set forth in
the body of the motion the applicable facts and law and attach a copy of the reasons given by the
district court for its order. The opposing party may file a response within 5 days after service of
the motion, unless the court directs that the time be shortened or extended.
(b) Requests for release from custody or for detention of a defendant after judgment of
conviction must be by motion filed expeditiously. The time periods and form requirements set
forth in 3d Cir. L.A.R. 9.1(a) are applicable to such motions.
