Necessity for Filing

It is not necessary to file a petition for panel rehearing or petition for

rehearing en banc in the court of appeals as a prerequisite to the filing of a petition for writ of

certiorari in the Supreme Court of the United States. Counsel are also reminded that the duty of

counsel is fully discharged without filing a petition for rehearing en banc if the rigid standards of

FRAP 40(b)(2) are not met.
