Continuance of Trial Date; Sanctions for Failure to Proceed

No continuance of a scheduled trial date will be granted except by order of the Court issued

in response to a motion made in accordance with the provisions of Civil L.R. 7. Failure of a

party to proceed with the trial on the scheduled trial date may result in the assessment of jury

costs and the imposition of appropriate sanctions, including dismissal or entry of default. Jury

costs may be also assessed for failure to provide the Court with timely notice of a settlement.

History

Commentary Counsel should consult any Standing Orders issued by the assigned Judge with respect to the conduct of trial. Such orders are available on the individual Judges’ pages of the Court’s website.
