§482.100 Condition of Participation: Organ Procurement
The transplant program must ensure that the hospital in which it operates has a written
agreement for the receipt of organs with an OPO designated by the Secretary that
identifies specific responsibilities for the hospital and for the OPO with respect to organ
recovery and organ allocation.
Guideline §482.100
The hospital in which the transplant program is located must have a written agreement with their
designated OPO for cooperation with the OPO in the recovery of donor organs unless the
hospital has been granted a waiver by CMS to work with another OPO. The agreement must
meet the requirements of §482.45 and §486.322.
