(4) RNHCIs must comply with the Federal, State, and Local laws pertaining to
“privacy of individual identifiable health information (45 CFR 164).”
Interpretive Guidelines: §403.738(c)(4)
The RNHCI must comply with requirements related to protected health information of
patients and compliance with applicable the Health Insurance Portability and
Accountability Act (HIPAA) Rules at 45 CFR parts 160 and 164.
Survey Procedures:
• Determine whether the facility is in compliance with Federal, State and local
laws. (Also refer to R176, R177, and R178)
