(5) Freedom from involuntary seclusion
Interpretive Guidelines: §403.730(c)(5)
Involuntary seclusion is the involuntary confinement of a person alone in a room or an
area where the person is physically prevented from leaving. A patient who is
involuntarily in a room isolated from the rest of a unit should be considered in seclusion.
RNHCIs may not use seclusion.
Survey Procedures:
• Interview staff and ask them if it is ever acceptable to confine an individual to a
room or area.
