(2) Make decisions regarding his or her care, including transfer and discharge from
the RNHCI. (See §403.736 for discharge and transfer requirements.)
Interpretive Guidelines: §403.730(b)(2)
The patient has the right to be involved in his or her plan of care. This includes active
participation and discussion with the RNHCI related to the transfer and discharge from
the organization. The RNHCI should have a policy and process related to sharing
information with the patient and/or patient’s representative on transfers and discharges,
whether this would be a discharge to the patient’s home, or into a healthcare setting
which provides medical services and nursing care.
Survey Procedures:
• Is there evidence that each patient was given information regarding the right to
make decisions?
• Does the patient understand what transfer and/or discharge means?
